1. Acceptance of Terms

By accessing or using PilotDM (“PilotDM,” “Company,” “we,” “our,” or “us”) and its automation software, website, and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you may not use the Services.

2. Description of Services

PilotDM provides automation tools that allow users to create, manage, and optimize automated workflows, processes, messaging, integrations, and related digital operations.

We reserve the right to modify, update, suspend, or discontinue any part of the Services at any time, with or without notice.

3. Eligibility

You must be at least 18 years old to use the Services. By using PilotDM, you represent and warrant that:

  • You are legally capable of entering into a binding agreement.

  • You will comply with all applicable laws and regulations.

If you are using the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

4. User Accounts

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information

  • Maintain the confidentiality of your login credentials

  • Be responsible for all activity under your account

  • Notify us immediately of unauthorized access

We reserve the right to suspend or terminate accounts at our discretion.

5. Acceptable Use

You agree not to use PilotDM to:

  • Violate any local, state, federal, or international law

  • Send unlawful spam or unsolicited communications

  • Engage in harassment, fraud, or deceptive practices

  • Infringe intellectual property rights

  • Transmit malware, viruses, or harmful code

  • Attempt unauthorized access to systems or data

  • Automate actions in violation of third-party platform terms of service

You are solely responsible for how you use automation workflows created through the Services.

6. Compliance With Third-Party Platforms

If you use PilotDM in connection with third-party platforms (e.g., social networks, messaging platforms, CRMs, email providers), you are responsible for complying with their terms and policies.

PilotDM is not responsible for account suspensions, penalties, or restrictions imposed by third-party platforms resulting from your use of automation.

7. Fees and Payments

If you subscribe to a paid plan:

  • You agree to pay all applicable fees.

  • Payments may be processed through third-party payment providers.

  • Subscription fees are billed in advance and are non-refundable unless required by law.

  • We may change pricing with reasonable notice.

Failure to pay may result in suspension or termination of Services.

8. Intellectual Property

All software, technology, content, branding, and materials provided by PilotDM are the property of PilotDM or its licensors and are protected by U.S. and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms.

You may not:

  • Copy, resell, or sublicense the Services

  • Reverse engineer or attempt to extract source code

  • Create derivative works based on the Services

9. User Content and Data

You retain ownership of any data, content, workflows, or materials you upload or create using the Services (“User Content”).

You grant PilotDM a limited, worldwide, royalty-free license to host, process, and transmit your User Content solely to provide and improve the Services.

You are solely responsible for:

  • The legality of your User Content

  • Ensuring you have rights to use the data you automate

  • Maintaining backups of your data

10. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

To the fullest extent permitted under U.S. law, PilotDM disclaims all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Availability or uninterrupted operation

We do not guarantee that automation workflows will perform without error or interruption.

11. Limitation of Liability

To the maximum extent permitted by U.S. law, PilotDM shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, goodwill, or business opportunities

  • Account bans or penalties from third-party platforms

12. Indemnification

You agree to indemnify and hold harmless PilotDM, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of:

  • Your use of the Services

  • Your violation of these Terms

  • Your violation of third-party rights

  • Your automated actions or campaigns

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or if we believe your use poses legal, reputational, or security risks.

Upon termination, your right to use the Services will immediately cease.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States.

Any disputes arising from these Terms or the Services shall be resolved exclusively in the courts of the United States.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted with a revised Effective Date.

Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
