1. About PilotDM

PilotDM is a Software-as-a-Service (SaaS) platform that automates social media interactions such as direct messaging, post scheduling, and engagement management. The platform supports major social media platforms including Instagram, Facebook, LinkedIn, and X (formerly Twitter), among others.

Our goal is to help users and businesses manage online communication efficiently while maintaining compliance with third-party platform rules.

2. Eligibility

To use PilotDM, you must:

• Be at least 18 years old;
• Have the legal authority to enter into binding agreements;
• Use the Service for lawful purposes and in compliance with all applicable laws and third-party terms.

If you use the Service on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.

3. Account Registration

To access most features, you must register for an account. You agree to:

• Provide accurate and complete information during registration;
• Keep your account credentials secure;
• Promptly notify us of unauthorized access or use.

You are responsible for all activity conducted through your account.

4. Subscription Plans and Payments

4.1 Subscription Plans

4.2 Billing and Renewal

• All subscriptions are billed in advance and renew automatically unless cancelled.
• You may cancel your plan at any time through your account settings. Your access remains active until the end of the billing cycle.
• You authorize PilotDM and its payment processors to charge your payment method for all applicable fees.

4.3 Refund Policy

All fees are non-refundable, except where required by applicable law. In cases of accidental duplicate billing or verified technical error, contact [email protected] for review.

4.4 Price Changes

We may modify our pricing at any time. Any changes will take effect at the start of your next billing cycle, and you will be notified in advance.

5. Acceptable Use Policy

You agree not to use PilotDM to:

• Send spam, bulk unsolicited messages, or automated replies violating platform policies;
• Violate the terms or rules of any third-party social platform;
• Engage in harassment, hate speech, impersonation, or fraud;
• Interfere with or disrupt the Service, servers, or connected networks;
• Reverse-engineer, decompile, or copy parts of the software or its codebase.

We reserve the right to suspend or terminate accounts that violate these conditions or any third-party API policies.

6. Integrations with Social Platforms

PilotDM integrates with social media platforms (including but not limited to Instagram, Facebook, LinkedIn, X/Twitter). By using these integrations, you agree that:

• Your activity is also subject to the respective terms of service and policies of each connected platform;
• PilotDM is not affiliated with or endorsed by these platforms;
• If any platform changes its API, access policies, or technical functionality, certain features of PilotDM may be limited or unavailable without notice;
• You are responsible for maintaining compliance with those platforms' automation and messaging rules.

7. Data Privacy

We collect and process data according to our Privacy Policy, which explains how we handle your information and connected social media data. By using the Service, you consent to the collection and use of your information as described in that policy.

8. Intellectual Property

All content, code, software, branding, and materials available through PilotDM are owned by or licensed to us and protected under intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business or personal social media management in accordance with these Terms. You may not reproduce, resell, or redistribute the Service or any of its components.

9. Service Availability and Modifications

We strive to ensure continuous operation but do not guarantee uninterrupted access or error-free performance. We may modify, update, suspend, or discontinue parts of the Service at any time without prior notice. We are not responsible for downtime caused by third-party API changes, maintenance, or other external factors.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available." PilotDM makes no warranties or representations regarding accuracy, reliability, or uninterrupted service. Your use of the Service is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by law:

• PilotDM and its affiliates shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service;
• Our total liability for any claim shall not exceed the total amount paid by you to PilotDM in the six (6) months preceding the event giving rise to the claim.

12. Termination

We may suspend or terminate your account without notice if:

• You violate these Terms or applicable laws;
• You misuse the Service or connected platforms;
• Required by law or by request of third-party platform providers.

Upon termination, your license to use the Service immediately ceases. You may also terminate your account at any time through your account settings.

13. Changes to the Terms

We may revise these Terms periodically. When updated, the "Last Updated" date at the top of this page will be revised. Continued use of the Service after updates constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of India, which shall have exclusive jurisdiction.
